Scott is a financial advisor serving the greater Raleigh, NC area. He began his career in the financial industry soon after retiring from the Army. Scott's military background allows him to closely understand the issues faced by our military personnel, but he works with clients from all walks of life. His desire is to continue his service to individuals in need of tax and financial advice. He is currently an Enrolled Agent, a candidate for CFP® certification, will complete his second undergraduate degree in accounting in the spring of 2019 and will begin taking the exams to become a licensed CPA in 2019.

Hi there Wine and Dime listeners, welcome to a very special edition of the show, where we are live at FinCon 2019. While here at the conference we were able to connect with a ton of people, and one of those people was Cathy Sikorski. This talk was a real treat, and we had a great conversation about elder law, and as Cathy pointed out to me, there is a big difference between elder law and estate law. And that is “Elder lawyer are for living people, Estate Lawyers are for dead people.” This was really engaging conversation that was enjoyed over a glass of wine, and I’m sure that you will enjoy the episode as much as I enjoyed sitting down with her!!
Cathy Sikorski
Cathy Sikorski has been a significant caregiver for the last 20 years. In addition to that, she has been a practicing attorney in her own practice, dealing largely in Elder Law, with over 12 years of education in issues dealing with Medicare, Medicaid and Social Security. She began her legal career in general practice in a small town where she grew up and was known to a large contingent of the population through her family. Many of her clients were older adults, which lent her practice to dealing with elder issues. During that time, Cathy went on leave to attempt stay-at-home mothering and ended up staying at home and mothering all kinds of people. First, her Nana came to stay. But since then, she has been the primary caregiver for her great aunt for seven years, her amazing mother-in-law until she almost reached 97 years old, currently her brother-in-law who is wheelchair bound and suffers from multiple sclerosis, and a very dear friend who is permanently disabled from an accidental brain injury four years ago.
Fortunately, each and every one of these special people has a rockin’ sense of humor during medical appointments, nudity, and other areas of indignity (well, except the great aunt…who didn’t like to laugh). So this caregiving thing, yea, she’s got it covered, and is continuously consulted by everyone she meets about caregiving personally and with her legal background.

Do you hate annuities?
In a recent USA Today article, Why I hate annuities: Here are the reasons these investments are bogus, Ken Fisher boldly starts out by stating “I’d die and go to hell before selling an annuity”. In his next breath he says he is not talking about single premium immediate annuities but seems to bash deferred annuities of any type.
“I’m not referring to simple immediate “fixed” annuities that convert one lump sum to income. Those can be OK, done right. But deferred annuities – “variables,” “indexed” and “deferred fixed” – are bogus. Here, you upfront cash for a contract that pays later. Meanwhile, your principal contract value supposedly grows.”
Hopefully Ken does really understand that a fixed or indexed annuity is going to grow guaranteed, not supposedly.
We often run into clients who want to protect their assets today and decide tomorrow what to do with them. They want to protect their principal from a sudden market decline they won’t have time to overcome. Fixed or indexed deferred annuities protect principal and grow tax deferred. Later, a client can decide to take an income.
Ken goes on to bash variable annuities because of their loads. Is he not aware of the VA’s available on RIA platforms? These plans offer much more competitive variable annuity products by lowering the fees inside and limiting insurance options and riders. These new products take some of the validity away from his statement.
It is his closing line which makes him look even more outdated and set in his ways
“Yes, my advice is conflicted – my firm often helps people exit deferred annuities. My opinion remains, regardless. All but simple immediate fixed annuities should be outlawed because buyers almost always misunderstand what they’re buying. It’s one step from fraud. Everyone deserves more transparent and flexible investments.”
At least Ken admits his conflict and bias and tells us he has no intent on offering insurance solutions no matter what their client needs or wants.

The value of guaranteed lifetime income continues to rise.
A recent study sheds some light on a perspective Ken might be trying to share – income riders can be more costly than a SPIA. They came to the following conclusion: “The dominant guaranteed lifetime income alternative is GLWBs (Guaranteed Lifetime Withdrawal Benefit Riders) on Variable Annuities and Fixed Indexed Annuities primarily because they provide flexibility in the event of a change in circumstance. This comes at a cost, but historically not high enough to overcome the illusion of control.”
They also address Ken’s bias noting: “Historic emphasis on recurring commissions and/or AUM-based fees has disadvantaged the selling of income annuities”. In their closing action items, they note: “Many more retirees would elect annuitized income if presented the option. For many retirees, a mixture of both “lifetime annuitized income” and “ad-hoc discretionary withdrawals” from retirement savings may be optimum.”

Market forces show interest in annuities of all types.
Ken is certainly right about the fact that some clients are better off without an annuity. But the market forces continue to show interest in annuities of all types. For most people, running out of money is their biggest fear. Annuities are uniquely designed to provide a lifetime guaranteed income. Forecasted Monte Carlo analysis can leave some clients feeling queasy and uneasy. When you present the results to a 65-year showing they have an 85% chance their money will last to age 90, I assure you some clients are worried if they are in the 15% quartile in addition to the concern of living past age 90. Thus, the reasonableness of the income study premise that some mixture is best.
Behavior modification is a large part of financial planning. Perhaps Ken should open his mind and consider utilizing annuities in the retirement planning process for certain situations and clients. There are certainly clients who will sleep better and worry less if they had enough steady guaranteed income. They fit especially well for your more conservative clients in good health, especially if there is longevity in the family.

John C. Ninfo, II
Judge Ninfo was a bankruptcy judge for the United States bankruptcy court, Western District of New York. He was appointed to the bench in 1992 and served as Chief Judge from January 1, 2000 until December 31, 2006. After 2006 he served as a judge until December 31, 2011.
Education and early life
Judge Ninfo attended Georgetown University for his Bachelors degree in 1968 and Boston University for his J.D. in 1973. From 1968 until 1970 he served in the United States Marine Corps, becoming Chief Legal Clerk to the Judge Advocate General of the 4th Marine Air Wing.
Career
From 1970 until 1992 he engaged in private law practice with the Rochester firm of Underberg and Kessler, specializing in creditors' rights and bankruptcy law.
CARE program
In 2002, Ninfo founded the Credit Abuse Resistance Education (CARE) program. It is a personal finance literacy education program in which bankruptcy judges, trustees, attorneys and court staff go into high schools and colleges and meet with businesses, faith groups and veterans in an effort to educate them on staying out of debt and financial responsibility.
CARE - Credit Abuse Resistance Education
CARE's mission is to educate individuals, with a focus on young adults, on the responsible use of credit and the fundamentals of financial literacy, as well as the potential consequences of poor money management and credit abuse.
Founded in 2002 by now-retired US Bankruptcy Court Judge John C. Ninfo II, Credit Abuse Resistance Education (CARE) was created to teach high school and college students about the responsible use of credit and the consequences of credit card abuse. Judge Ninfo grew the organization to have a national presence by helping other bankruptcy professionals start their own CARE programs across the nation.
Upon his retirement, Judge Ninfo turned CARE over to the American Bankruptcy Institute in Alexandria, VA, where it expanded and developed into a nationally branded organization. In 2016, CARE received its 501(c)(3) status from the IRS and has emerged as a national nonprofit community service organization dedicated to inspiring smart financial-decision making by students and young adults.
Now, 15 years after its creation, our organization recruits and trains professionals in the bankruptcy and other financial services fields, who are then invited to schools and other venues to teach the fundamentals of personal financial management.

Malbec is a purple grape variety used in making red wine. The grapes tend to have an inky dark color and robust tannins, and are known as one of the six grapes allowed in the blend of red Bordeaux wine. The French plantations of Malbec are now found primarily in Cahors in South West France. It is increasingly celebrated as an Argentine varietal wine and is being grown around the world.
Called Malbec in Bordeaux, Auxerrois or Côte Noir in Cahors, and Pressac in other places, the grape became less popular in Bordeaux after 1956 when frost killed off 75% of the crop. Despite Cahors being hit by the same frost, which devastated the vineyards, Malbec was replanted and continued to be popular in that area where it was mixed with Merlot and Tannat to make dark, full-bodied wines, and more recently has been made into 100% Malbec varietal wines.
The Malbec grape is a thick-skinned grape and needs more sun and heat than either Cabernet Sauvignon or Merlot to mature. It ripens mid-season and can bring very deep color, ample tannin, and a particular plum-like flavor component to add complexity to claret blends. Sometimes, especially in its traditional growing regions, it is not trellised and cultivated as bush vines (the goblet system). The wines are rich, dark and juicy.
As a varietal, Malbec creates a rather inky red (or violet), intense wine, so it is also commonly used in blends, such as with Merlot and Cabernet Sauvignon to create the red French Bordeaux claret blend. The grape is blended with Cabernet Francand Gamay in some regions such as the Loire Valley. Other wine regions use the grape to produce Bordeaux-style blends. The varietal is sensitive to frost and has a proclivity to shatter or coulure.
